Last Will And TestamentProbate or Estate Administration is the process of collecting a decedent’s assets, satisfying any outstanding debts, resolving conflicts among beneficiaries, and appropriately distributing the remainder of the estate to persons or institutions.


Depending on how bank accounts and property is titled, banks may not be able to release property or even accept payments from the living heirs until an executor or personal representative is established. If the decedent left a will naming an executor, the will needs to be authenticated before the clerk of court or another legal authority. If the decedent died intestate, meaning the decedent died without a will, someone – usually a family member – needs to be appointed the Personal representative.
